UK OFFICIAL RULES

1. SWEEPSTAKES SPONSOR

Fox Factory UK Limited, Company Number 10764403 with its registered office at 7th Floor 50 Broadway, London, United Kingdom, SW1H 0DB (“Sponsor”), is the sole sponsor of the Podium Gold Service Promo Sweepstakes (“Sweepstakes”). The Sweepstakes are in no way sponsored, endorsed, administered by, or associated with, Instagram nor Facebook.

2. ENTRANT ELIGIBILITY

To be eligible to participate in the Sweepstakes, you must: (i) be a UK resident; and (ii) be at least eighteen (18) years of age on the date you submit your entry. Sponsor reserves the right to require evidence of age and residency before any Prize is awarded to you.

Employees, officers, directors, and assigns of Sponsor, or its parents, subsidiaries, affiliated companies, agents, distributors, dealers, advertising, promotion, and production agencies, or members of their respective immediate families (parents, spouse, children, siblings) or individuals residing in their households (whether or not related), and currently sponsored athletes by the Sponsor, are not eligible to enter the Sweepstakes or to win the Prize.

By participating in the Sweepstakes, you: (a) agree to be bound by these Official Rules, the interpretations of these Official Rules by Sponsor and by the decisions of Sponsor; (b) acknowledge compliance with these Official Rules; and (c) represent that you meet all the eligibility criteria set forth in these Official Rules. If a prize winner is found to be in violation of any of these Official Rules, he/she will be required to forfeit the Prize. The Sponsor reserves the right to refuse entry, or refuse to award the Prize to anyone in breach of these Official Rules.

3. HOW TO ENTER

During the Sweepstakes, you may enter in one of two ways (each an “Entry” and collectively the “Entries”): (i) by booking a fork, shock or dropper post service using the official FOX service form (https://service.ridefox.com/pages/bike); or (ii) you may enter the Sweepstakes by mail. To enter by mail, hand-print your name, full address address, date of birth, email address and daytime telephone number on a postcard card, and mail it, in a envelope with sufficient postage affixed, to: Fox Factory UK, Fox Podium Gold Service Promo Sweepstakes, Unit B1, Kingswey Business Park, Forsyth Rd, Woking GU21 5SA. Mail-in entries must be postmarked by the Sweepstakes end date and received by Sponsor no later than five (5) days after the Sweepstakes end date to be eligible for entry. No photocopied, computer-generated facsimiles, mechanically reproduced, or mass entries permitted. One entry per postmarked envelope. Each mail-in entry will be considered equivalent to an entry made by booking a post service online. Satisfactory completion, as determined by Sponsor, of either method of entry will provide one (1) Entry into the Sweepstakes. All entries must be received by 11:59 PM GMT on August 31, 2024 in order to enter. If you submit your entry via your wireless phone, message and data rates may apply.

There is a limit of one Entry per individual. Entrants may only use one email address to enter the Sweepstakes. Entries received from any person or email address in excess of one entry will be void. You may not enter more times than indicated by using multiple email addresses, social media accounts or posts, identities, or devices in an attempt to circumvent the Official Rules, as determined within Sponsor’s sole discretion. If you use fraudulent methods or otherwise attempt to circumvent the Official Rules, your entry may be removed from eligibility at the sole discretion of Sponsor.

Sponsor has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to remove entries for any reason, including, but not limited to, the use of bots, macros or scripts or other technical means for entering.

In the event of a dispute regarding entries received from multiple users having the same e-mail account, the authorised subscriber of the e-mail account at the time of entry will be deemed to be the entrant and must comply with these Official Rules. Authorised email account subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organisation responsible for assigning e-mail addresses.

4. ENTRY PERIOD

You may enter the Sweepstakes beginning 9:00 AM GMT on June 1, 2024 through 11:59 PM GMT on August 31, 2024 (“Entry Period”). Any entry that is not completed within the Entry Period or is otherwise incomplete or ineligible when uploaded within the Entry Period will not be considered and will not be valid.

5. PRIZES

There will be one (1) total prizes awarded in the Sweepstakes (the “Sweepstakes Prize”). The Sweepstakes Prize consist of: one limited edition podium gold fork of the winner’s choice. The winner may choose from a size 36 fork or a size 38 fork (each item individually, a “Prize”). The Approximate retail value (“ARV”) of the Sweepstakes Prize is between One Thousand Three Hundred Fourty-Nine Pounds (£1349.00) and One Thousand Four Hundred Thirty-Nine Pounds (£1439.00). Actual ARV depends on the prize selected by the winner.

Prizes are provided by Sponsor. Prizes are non-exchangeable, non-transferable and no cash redemption or prize substitution or alternative is allowed, except at Sponsor’s sole discretion.Prizes are not provided in installments and are not to be shared among multiple winners.

Sponsor reserves the right to substitute any or all Sweepstakes Prizes, or a portion thereof, for another item of equal or greater value if circumstances beyond the Sponsor’s control makes it necessary to do so.

Sweepstakes Prizes will be awarded only if the entrant fully complies with these Official Rules. The decision of the Sponsor regarding any aspect of the prize draw is final and binding and no correspondence will be entered into about it.

6. RANDOM DRAWING AND ODDS OF WINNING

One (1) prize winners will be selected by Sponsor in a random drawing by a computer process on or about September 4, 2024 from all eligible entries received and combined throughout the Entry Period. Odds of winning a prize depend on the number of the total eligible entries received and combined throughout the Entry Period.

7. SELECTION OF WINNERS

A potential winner will be notified by Sponsor via phone and/or e-mail (using details provided at entry) before September 6, 2024. The potential winner will be required to confirm via email his/her full name, postal address to claim their Prize, date of birth, phone number or email address, and social media handle (if applicable), within forty-eight (48) hours from contact.

If a potential winner does not confirm his/her contact information as requested or cannot be reached within the forty-eight (48) hour time period, and/or does not meet the eligibility requirements set out in these Official Rules, then the potential winner’s Prize will be forfeited, and the Sponsor will be entitled to select another winner in accordance with the process described above.

Sponsor reserves the right to require the winner to demonstrate all of the eligibility requirements for entry, including but not limited to, ownership of the Instagram account or other social media account (if appliable), a form of identification which confirms age, and proof or purchase associated with the winning Entry before the Sweepstakes Prize will be awarded.

The Prize will be sent to the winner by post within thirty days of being notified of their win.

8. PUBLICITY RELEASE

By participating in the Sweepstakes and by accepting a Prize, a prize winner (i) grants permission for Sponsor and its designees to use his/her name, address (city and county), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes without further compensation, in all media, worldwide in perpetuity, without notice or review or approval and (ii) grants the right to Sponsor, and its representatives, affiliates, licensees and assigns, to record, film, videotape and photograph the prize winner (“Images”). These Images will be owned by Sponsor. Sponsor and each of its designees shall have the right to use, re-use, reproduce, publish, display, exhibit, distribute, edit, adapt, post, stream, copy and exploit such Images, and all elements embodied therein, including any names, likenesses, address, voice, conversation, biographical and prize information and any other attributes of the prize winner, individually or with others, in whole or in part, in conjunction with other material for the purpose of trade, advertising, publicity, promotion, or a Sweepstakes winner list or any other lawful purpose whatsoever.

The Sponsor is required to either publish or make available information that indicates that a valid award took place. To comply with this obligation, Sponsor will (a) publish this information on its website, (b) send the surname and county of major Prize winners and, (c) (if applicable), send copies of winning entries, to anyone who emails [EMAIL ADDRESS] or writes to [ADDRESS]. If you object to any or all of your surname, county and winning entry being published or made available, please contact the Sponsor [INSERT CONTACT DETAILS/ LINK TO CONTACT DETAILS]. In such circumstances, the Sponsor must still provide the information and winning entry to the UK Advertising Standards Authority on request.

9. OPERATION OF THE SWEEPSTAKES

Sponsor has the right to disqualify any potential winner if Sponsor determines, in its sole discretion, that the Entry is fraudulent, or entrant has not complied with and/or is ineligible under these Official Rules.

Sponsor is not responsible for illegible, lost, stolen, late, damaged, incomplete, mutilated or misdirected entries or for any problems or any technical malfunctions related to the electronic submission of Entries or the operation of the Sweepstakes.

If the required information is not provided or an Entry is illegible, or technically inaccessible, the entry will be deemed ineligible. Any Entry that does not comply with the Official Rules may be withdrawn, rejected, and deemed ineligible for participation in the Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned, Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Sweepstakes, where it becomes necessary to do so.

10. PRIZE CONDITIONS

SWEEPSTAKES PRIZES ARE PROVIDED “AS IS.” Sweepstakes Prizes pictured in online, television, print advertising, and other Sweepstakes materials are for illustrative purposes only. Arrangements for the fulfillment of the Prizes will be made by Sponsor.

The Sponsor accepts no responsibility for entries not successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.

Insofar as is permitted by law, the Sponsor, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize, except where it is caused by the negligence of the Sponsor, its agents or distributors or that of their employees.

Your statutory rights are not affected.

11. GOVERNING LAW

These Official Rules and the Sweepstakes are governed by English law and wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.

12. PRIVACY POLICY

Any personal data submitted by entrants will be processed in accordance with the Sponsor’s Privacy Policy as stated at https://www.ridefox.com/tos.php?p=privacy.

13. LANGUAGE

Sponsor, in its sole discretion, may reproduce these Official Rules in multiple languages. The English version of these Official Rules shall prevail and govern the Sweepstakes in all matters whatsoever.
